      'Cell phone Law' is amended to a primary offense.

- March 1st, 2008 -


The use of hand-held cell phones while driving becomes a primary motor vehicle offense.

Drivers may continue to use their cell phones if they have a headset or other hands-free device.

This law prohibits the hand-held use of an electronic communication device while driving.

Talking, text messaging, emailing, etc. are examples of prohibited hand-held activity while driving.

 

However, there are exceptions.

 

If drivers fear for their safety, witnesses a crime, fire or a traffic accident, they can use the cell phone to call for help.

 

Emergency Personnel such as police, fireman, and any authorized emergency vehicle,

are exempt if the hand-held  use is during the performance of their official duties.

 

Fines for this violation range from $100.00 to $250.00.
